1. Parties and Acceptance

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("the Buyer") and PeptAus Pty Ltd ACN [ACN pending] ("PeptAus", "we", "us"), a company registered in New South Wales, Australia, operating at peptaussciences.com.

By accessing this website, creating an account, or completing a purchase, you unconditionally accept these Terms in their entirety. If you do not accept them, you must immediately cease using this website and must not place any order.

2. Eligibility and Purchaser Declarations

By placing an order you irrevocably declare and warrant that:

• You are at least 18 years of age;
• You are acquiring the products solely for lawful in vitro scientific research purposes and not for personal, domestic, household, human consumption, or veterinary use;
• You have the legal capacity to enter into a binding contract under the laws of your jurisdiction;
• You are not acquiring the products as a "consumer" within the meaning of section 3 of the Competition and Consumer Act 2010 (Cth) Schedule 2 (Australian Consumer Law), given that your acquisition is for the purposes of a business or research undertaking;
• You understand and accept full personal responsibility for compliance with all applicable laws in your jurisdiction regarding the receipt, storage, handling, and use of these compounds;
• You will not on-sell or supply any product to a person who intends to use it for human or veterinary purposes.

PeptAus reserves the right to refuse or cancel any order at its sole discretion, including where it has reasonable grounds to believe these declarations are false.

3. Nature of Products — TGA Compliance

PeptAus supplies research-grade peptide compounds and ancillary research products. These products:

• Are intended solely for in vitro laboratory and scientific research — meaning use outside a living organism, in a controlled research environment;
• Have not been evaluated or approved by the Therapeutic Goods Administration (TGA) or any other regulatory authority for therapeutic, diagnostic, prophylactic, or any other use in or on humans or animals;
• Are not therapeutic goods within the meaning of the Therapeutic Goods Act 1989 (Cth) when supplied and used in accordance with these Terms;
• Must be stored, handled, and disposed of in accordance with all applicable safety, environmental, and regulatory requirements;
• Are supplied with a Certificate of Analysis (COA) issued by an independent third-party laboratory, confirming identity and purity. This COA does not constitute regulatory approval of any kind.

Nothing on this website constitutes a therapeutic claim, medical advice, or an endorsement of any particular use. PeptAus expressly disclaims all implied representations that any product is fit for therapeutic use.

4. Contract Formation and Orders

An order submitted through our website constitutes an offer to purchase. A binding contract is formed only when PeptAus confirms acceptance of your order by email or by dispatching the goods, whichever occurs first. PeptAus may decline any order without providing reasons.

Product descriptions, images, and purity specifications are provided in good faith based on available COA data at time of listing. Minor batch-to-batch variation in purity within commercially accepted tolerances does not constitute grounds for rejection.

5. Pricing, GST and Payment

All prices are displayed in Australian Dollars (AUD) inclusive of GST (where applicable under the A New Tax System (Goods and Services Tax) Act 1999 (Cth)). PeptAus reserves the right to amend pricing without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.

Payment is required in full prior to dispatch. We currently accept:

• PayID / Bank Transfer — via the Australian New Payments Platform (NPP). Payment reference must include your order number and full name. We are not responsible for delays caused by your financial institution's hold policies.
• Cryptocurrency — Bitcoin (BTC), Ethereum (ETH), or USDT (ERC-20). A 10% discount applies automatically. You are responsible for sending the exact amount and correct network. PeptAus is not liable for funds sent to incorrect addresses or on incorrect networks. Cryptocurrency transactions are irreversible.

Orders will not be dispatched until cleared funds are received and confirmed. For cryptocurrency orders, dispatch occurs following blockchain confirmation (typically 10–60 minutes from receipt).

6. Shipping and Delivery

PeptAus dispatches from Sydney, NSW via Australia Post Express Post. Orders received before 12:00pm AEST on business days are dispatched same day, subject to payment clearance. Delivery timeframes are estimates provided by Australia Post and are not guaranteed by PeptAus.

Risk of loss or damage passes to the Buyer upon handover of the goods to Australia Post. Title to goods passes to the Buyer upon receipt of full payment.

PeptAus will reship confirmed lost orders at no charge (where tracking confirms non-delivery). We are not liable for delays caused by Australia Post, extreme weather, or circumstances beyond our reasonable control.

7. No Refund Policy

PeptAus does not accept returns or provide refunds except as expressly set out in this clause or as required by law.

Specifically:

• Change of mind: No refunds or exchanges are available for change of mind under any circumstances. Research compounds are non-returnable once dispatched.
• Storage and handling: Once goods leave our facility, we cannot verify the conditions under which they have been stored or handled. Accordingly, we do not accept returns for any reason related to a claim of product deterioration or inefficacy after dispatch.
• Incorrect orders placed by the Buyer: We do not accept returns or issue refunds where the Buyer ordered the incorrect product. Please review your order carefully before submitting.
• Import/customs issues: PeptAus ships within Australia only. We accept no responsibility for any regulatory or customs issues.

Limited exceptions — we will provide a replacement or store credit (at our election) where:

• The product arrives in a condition that is visibly damaged as a result of transit;
• You receive a product that does not match your confirmed order (wrong product or wrong quantity);
• The product is demonstrably mislabelled relative to its COA.

All exception claims must be lodged within 48 hours of delivery via email to research@peptaussciences.com.au with your order number, clear photographic evidence of the issue, and the product in its original packaging. We reserve the right to request return of the product (at our cost) before issuing any remedy.

8. Statutory Guarantees — Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, or condition imposed by legislation (including the Competition and Consumer Act 2010 (Cth) Schedule 2 — the Australian Consumer Law) that cannot lawfully be excluded or limited.

Where the ACL applies and cannot be excluded, our liability for failure to comply with a consumer guarantee is limited to, at our election: (a) the replacement of the goods or the supply of equivalent goods; or (b) the payment of the cost of replacing the goods or acquiring equivalent goods.

For the avoidance of doubt, PeptAus's position is that purchases made pursuant to these Terms are not consumer acquisitions within the meaning of section 3 of the ACL, given that the Buyer has declared that the goods are acquired for the purposes of a research undertaking and not for personal, domestic, or household use. Accordingly, the ACL's consumer guarantee provisions are not engaged. Nothing in this clause is an admission to the contrary.

9. Disclaimer of Warranties

To the maximum extent permitted by law, PeptAus provides all products "as supplied" for research purposes only. We make no representation or warranty, express or implied, that any product is:

• Fit for any particular research purpose beyond the purity and identity represented in the accompanying COA;
• Free of contaminants not tested for in the COA;
• Suitable for use in any specific experimental protocol;
• Stable beyond the recommended storage conditions and timeframes stated.

10. Limitation of Liability

To the fullest extent permitted by law:

• PeptAus's total aggregate liability to the Buyer under or in connection with these Terms shall not exceed the total amount paid by the Buyer for the specific order giving rise to the claim;
• PeptAus shall have no liability whatsoever for any indirect, consequential, special, incidental, punitive or economic loss or damage, loss of profits, loss of data, loss of opportunity, or loss of goodwill, arising under or in connection with these Terms, whether in contract, tort (including negligence), statute or otherwise;
• PeptAus shall have no liability for any loss or damage arising from: the Buyer's misuse of any product; use of any product otherwise than in strict accordance with these Terms; reliance on any information on this website other than COA-stated purity specifications; or any regulatory, legal, or enforcement action taken against the Buyer in connection with their use of the products.

11. Indemnification

You agree to indemnify, defend, and hold harmless PeptAus, its officers, directors, employees, contractors, and agents from and against any claim, loss, damage, liability, cost, or expense (including reasonable legal fees) arising from: (a) your breach of these Terms or your purchaser declarations; (b) your misuse of any product; (c) any claim by a third party arising from your use or distribution of any product; or (d) your violation of any applicable law.

12. Prohibited Uses

You must not use this website or any product purchased from PeptAus to:

• Administer any compound to any human or animal;
• Resell or redistribute any product to any person you know or suspect intends human or veterinary use;
• Make any therapeutic, health, or efficacy claim in connection with any product;
• Engage in any activity that constitutes an offence under Commonwealth or State law, including the Therapeutic Goods Act 1989 (Cth) or applicable Poisons Standard;
• Circumvent, disable, or interfere with any security or age-verification feature of this website.

13. Intellectual Property

All content on this website, including but not limited to text, product descriptions, imagery, branding, and code, is the intellectual property of PeptAus Pty Ltd and is protected by Australian copyright law. You may not reproduce, distribute, or use any content without prior written consent from PeptAus.

14. Website Availability and Accuracy

PeptAus makes no warranty that the website will be available continuously or error-free. We reserve the right to modify, suspend, or discontinue any part of the website at any time. Product availability is subject to change without notice.

15. Amendments

PeptAus may update these Terms at any time by posting a revised version to this page. The "last updated" date will be revised accordingly. Continued use of the website following any update constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

16. Governing Law and Dispute Resolution

These Terms are governed exclusively by the laws of New South Wales, Australia, and the applicable Commonwealth laws of Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.

In the event of a dispute, the parties agree to first attempt resolution by good-faith negotiation. If unresolved within 30 days, either party may refer the dispute to a mediator agreed between the parties, with costs shared equally. If mediation fails, either party may commence proceedings in a court of competent jurisdiction in New South Wales.

17. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies published on this website, constitute the entire agreement between you and PeptAus regarding the subject matter herein and supersede all prior agreements, representations, or understandings, whether written or oral.

Last updated: April 2026. PeptAus Pty Ltd is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, use, disclose, and protect your personal information.

PeptAus Pty Ltd ("PeptAus", "we", "us") is an Australian-owned business operating at peptaussciences.com. This Privacy Policy applies to all personal information collected through our website, order process, and communications. It is written in compliance with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs).

By using our website or purchasing from us, you consent to the collection and use of your personal information as described in this policy.

2. What Personal Information We Collect

We collect only the personal information that is reasonably necessary for our functions. This includes:

5. Disclosure to Third Parties (APP 6 & 8)

We do not sell, rent, trade, or share your personal information with third parties for their own marketing purposes. We may disclose your personal information to the following limited categories of third parties, strictly for the purposes of fulfilling our obligations to you:

• Australia Post: Your name and delivery address are provided to Australia Post for the purpose of delivering your order. Australia Post operates under its own Privacy Policy.
• Order notification service (Web3Forms): When you place an order, your order details (name, email, address, order contents, payment method) are transmitted to Web3Forms (web3forms.com), a third-party form submission service, for the purpose of delivering an order notification to our operations email. Web3Forms may process this data on servers located outside Australia. We have assessed this cross-border disclosure as carrying appropriate data handling standards for this limited purpose.
• Regulatory and law enforcement authorities: We may disclose personal information where required to do so by a court order, subpoena, regulatory demand, or applicable law, including disclosure to the Therapeutic Goods Administration (TGA), Australian Border Force, or Australian Federal Police.

We do not use any third-party advertising platforms (e.g. Facebook Pixel, Google Ads) that collect personal information through our website at this time.

6. Payment Information

PeptAus does not collect, store, or process payment card numbers. We accept payment exclusively via PayID bank transfer and cryptocurrency. For PayID payments, your bank processes the transaction directly. For cryptocurrency transactions, the blockchain network facilitates the transfer. We receive only a confirmation of payment and your transaction reference — no payment credentials are transmitted to or stored by PeptAus.

7. Direct Marketing (APP 7)

We may send you promotional emails about new products, special offers, and research updates, but only where you have opted in to receive such communications (e.g. by ticking the newsletter checkbox at account creation or checkout).

You may opt out of marketing communications at any time by:

• Clicking the unsubscribe link in any marketing email; or
• Emailing us at research@peptaussciences.com.au with "Unsubscribe" in the subject line.

Opting out of marketing will not affect transactional communications related to your orders.

8. Cookies and Tracking (APP 1)

Our website uses browser-based local storage and session cookies for the following limited purposes:

• Maintaining your shopping cart during a session;
• Remembering your account login state;
• Storing your age gate confirmation.

We do not use third-party advertising cookies or cross-site tracking cookies. You may clear cookies and local storage at any time through your browser settings. Doing so will clear your cart and session.

9. Cross-Border Disclosure (APP 8)

Your personal information is stored primarily within Australia. However, as noted in clause 5, limited order data is transmitted to Web3Forms, which may process data on servers located outside Australia (United States). Before disclosing personal information to overseas recipients, we take reasonable steps to ensure the recipient does not breach the APPs in relation to that information. By using our website, you consent to this limited cross-border disclosure for the purpose of order fulfilment notifications.

10. Data Security (APP 11)

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. Our security measures include:

• SSL/TLS encryption on all web traffic;
• One-way password hashing (passwords are not stored in recoverable form);
• Account data stored in browser local storage only — not on our servers;
• Restricted access to order notifications (delivered only to our operations email);
• No payment credential storage of any kind.

In the event of a data breach that is likely to result in serious harm to individuals, PeptAus will comply with its mandatory notification obligations under Part IIIC of the Privacy Act 1988 (Cth) — the Notifiable Data Breaches scheme.

11. Data Retention (APP 11)

We retain personal information only for as long as necessary for the purposes for which it was collected, or as required by law. Order and customer records are generally retained for a minimum of 7 years to satisfy our obligations under the Income Tax Assessment Act 1997 (Cth) and applicable Australian accounting standards. After this period, records are securely destroyed or de-identified.

12. Access to and Correction of Your Personal Information (APP 12 & 13)

You have the right to request access to the personal information PeptAus holds about you, and to request corrections where that information is inaccurate, out of date, incomplete, irrelevant, or misleading.

To make an access or correction request, email research@peptaussciences.com.au. We will respond within 30 days. We may ask you to verify your identity before we provide access. In limited circumstances we may decline an access request as permitted by the APPs, in which case we will explain why in writing.

We do not charge for making an access request or for correcting your information.

13. Anonymity and Pseudonymity (APP 2)

Where lawful and practicable, you may interact with us anonymously (e.g. browsing our website without creating an account). However, we cannot fulfil an order, process a payment, or respond to a customer service enquiry without collecting sufficient personal information to do so.

14. Privacy Complaints (APP 1)

If you believe PeptAus has breached the APPs or handled your personal information in a manner inconsistent with this policy, you may lodge a complaint by emailing research@peptaussciences.com.au with "Privacy Complaint" in the subject line. Please describe the nature of your complaint and the outcome you are seeking.

We will acknowledge your complaint within 5 business days and provide a substantive response within 30 days. If you are not satisfied with our response, you may refer your complaint to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or by calling 1300 363 992.

We may update this Privacy Policy from time to time. We will post the updated version on this page with a revised "last updated" date. Shipping Policy

Fast, reliable express shipping from our Sydney, NSW warehouse to all of Australia.

Shipping Methods & Timeframes

• AusPost Express Post — 1–3 business days metro, 2–5 days regional. $12.95 flat rate. FREE on orders over $200.
• AusPost Standard Post — 3–7 business days. $6.95 flat rate.

Tracking

A tracking number is emailed to you once your order is dispatched. You can track via the AusPost website or app. Tracking is available on all orders.

Discreet Packaging

All orders are packed in plain outer packaging with no mention of PeptAus or the contents on the outside. Product names do not appear on shipping labels.

Lost or Damaged Orders

If your tracked order is confirmed lost by AusPost, we will reship at no charge. If your order arrives damaged, contact us within 7 days with photos. We do not cover delivery delays caused by AusPost or adverse weather.

International Shipping

Currently we ship within Australia only. International shipping is under consideration.

Refund & Returns Policy

Eligible Refunds

We offer a refund or replacement if:

• Your order arrives visibly damaged
• You received the wrong product
• A product is demonstrably defective or fails COA verification

How to Claim

Email research@peptaussciences.com.au within 7 days of delivery with your order number and photos of the issue. We will respond within 2 business days. Approved refunds are processed within 5 business days to your original payment method.
